On April 4, 2003, NeverAgain (screen name from the CarTrackers.com forums),
had his day in small claims court in New Brunswick. After many, many months
of waiting, he finally received his judgement. His case was dismissed
without costs, meaning in essence that Ford won.
Here is an
exerpt from his email dated September 9/03:
"The
judge believed the district rep when he said that 'due to low interest
rates and incentives to buy new vehicles, the windstar would show larger
than usual depreciation'. He also believed the mechanic when he said the
problem was fixed in 96--the head gasket problem. The judge also said
I did not prove the extended warranty I bought--at the ford dealer--was
actually ford's warranty. It was but too late now. The only other thing
mentioned was the fact that I did not have my antifreeze flushed at 60000kms--the
dealer never mentioned that when I brought it in there. The only thing
in my favout was the fact that they could not explain why the dealer put
'Stop Leak' along with a flush in my rad at 70000kms---that was when I
brought it in complaining of coolant loss----while still under warranty.
The judge stated maybe I should have sued the dealership instead.
Anyways----the
case was dismissed without costs---meaning I don't have to pay theirs.
It would have been cheaper [for Ford] to help me fix my van instead of
paying a lawyer and two others to defend themselves.
My advice
to any going to court---bring fellow owners with problems and possibly
a mechanic. I think I could have shown they were lying if my mechanic--who
also was ford trained was there"
